Terms & Conditions For ( PRIVATE TRANSPORTATION TERMS )

IMPORTANT Services NOTE: Please note that we as Florida Shuttle Services are the reservations/booking company. The actual transportation services are provided by third party companies we do business with.

Our Guarantee assures that when you book with us and encounter any problem with your booking, we will do everything possible to make it right and keep you informed.

If any severe weather or other Act of God delays our service area or interrupts your reservation, we will waive all cancellation fees and process a full refund.

Providing transportation to the traveling public is a privilege that we have been serving for many years. In our experience, we have come to realize that occasionally, things do go wrong. Delays do happen and in most cases, they are beyond our control.

We will offer our customers a 100% refund if your trip is canceled by us or not provided due to things beyond our control.

TERMS & CONDITIONS

1. Payment

Payment is due when the reservation is made. We gladly accept Visa, MasterCard, Discover and American Express online or by telephone.

2. Cancellation, Refunds, Travel Changes and Last Minute Reservations:

Cancellations of shared shuttle reservations are acceptable only via email. A refund will be issued minus a $10 cancellation fee. In order to be eligible for a refund, the cancellation must be done with at least 48hrs notice or sooner prior to the travel date. Important NOTE: If cancellation is done less than 48 hrs in advance, your reservation will not be eligible for a credit for a future travel date. Please note that if cancellation is attempted via telephone, it will not be acknowledged and you will be noted as a no show therefore loosing your ticket fully 100% not eligible for any type of compensation. Also, if you do not receive a confirmation back confirming cancellation it means that we have not received email and your reservation has not been canceled.

Cancellation of reservation within 48 hours of travel under any circumstance is 100% not eligible for refund. Cancellation requests are not accepted by telephone. Travel purchased using a promotion code is 100% Non-Cancellable, Non-Changeable & not eligible for future credit. This includes our “Last Minute Specials” as well.

Changes are accepted with at least with at least 48hrs notice prior to departing date and time at a $10 change fee per person only accepted via email at [email protected] . If change request is not received via email or within the allowed time frame it will NOT be honored and a new reservation will need to be made.

Last minute bookings/reservations (within 48 hour frame) of travel are 100% not eligible for future credit, it is the passenger’s responsibility to contact us prior to making reservation to confirm availability. If passenger calls and there is no availability, and still makes reservation via website with the knowledge that there is no available transportation, Florida Shuttle Services is not responsible to issue refunds; it is the sole responsibility of the passenger.

IMPORTANT NOTE: Reservations less than 12 hours are not acceptable and not eligible for future credit.

Reservation Reinstatement Requests:
Reinstatement requests are allowed at a charge of $10 per person per way,upon availability and are NOT guaranteed . We need to receive prior authorization of said charge prior to reinstating confirmation and reporting reinstatement to transportation provider, dispatcher and appropriate parties concerned. If we do not receive a response we will assume there is no authorization therefore reinstatement will not take effect and reservation will remain canceled.

3. CHARGE BACKS

If you attempt a charge back because you did not qualify for a refund, please note our procedure. We will respond to such charge backs immediately. We then depending upon the dollar amount can/will file charges of credit card fraud with the County Sheriff (Please note that the dollar threshold in Florida is very low to become a felony). You can also be subject to civil penalties of up to 3 times the amount of booking or a minimum of $200.00, plus court cost and legal fees. We also may send your information to our associations and other transportation companies impeding your ability to get transfers in the future within the State of Florida. Florida Shuttle Services as well as other transportation companies have zero tolerance for credit card fraud and work together to combat it.

4. Request of Travel Changes

Customers who have a confirmed reservation made through our web site or by telephone is entitled to make changes to their travel plans at a fee of $10.00 per person plus any additional fare changes. All travel changes MUST be completed through our Reservations Department at the following email: [email protected] . Changes will not be accepted via telephone!

a. Please have your Transaction ID (Confirmation Number) available when calling the Reservations Department. Changes of travel within 48 hours of travel under any circumstance is 100% Non-Changeable and Non-Refundable. Travel purchased using a promotion code is 100% Non-Cancellable, Non-Changeable & Non-Refundable. This includes our “Last Minute Specials” as well.

b. Storm Policy

In the event that the National Weather Service issues a Tropical Storm Warning / Watch or a Hurricane Warning / Watch, customers with a confirmed reservation may make a one-time change to another date without penalty or charge. In order to make a change, please use the “Contact Us” form on our website and supply us with your confirmation number and the date you are requesting to change to.

3. Customer Responsibility

It is the customer’s responsibility to read the Terms and Conditions BEFORE placing a reservation. All information entered into the reservation form is the customer’s responsibility to be accurate. Refunds will not be issued for unused travel under any circumstances. Once the Submit Button is clicked, all sales are final and changes will be subject to a $10.00 change fee.

NOTE: If you miss your scheduled shuttle for any reason, your ticket becomes invalid and no refund will be issued under any circumstances. Unused tickets will not be honored for another date, trip or time and will not result in a refund or a credit towards future travel. Passengers are considered a “No-Show” unless they are on their originally scheduled shuttle. Passengers that are “No-Show” will not receive a refund under any circumstance.

Door to Door Service Areas

For our scheduled trips which include a door pick up and/or door drop off, area restrictions apply. If you choose an area outside of our service area (5 miles from main pick up station), we will automatically choose a destination closest to your desired point of travel and inform you by telephone. Refunds will not be issued if you elect not to travel under any circumstances. It is the customers responsibility to check mileage prior to submitting reservation. Not responsible for door pick up and/or door drop off addresses that do not fit our eligibility requirements, 100% non refundable. Areas of door to door service include ONLY: Orlando, Kissimmee & Davenport.

Promotion Codes

We are pleased to offer promotion codes. No Promo Codes are accepted for telephone reservations. Incorrectly entered promo codes that do not automatically calculate the discounted fare will not be eligible for refunds after the reservation has been submitted. Please read the instructions carefully!

Departure & Arrival Times For Scheduled Shared Shuttles

All times posted on our website are “scheduled” and approximate, however, due to traffic, weather conditions, mechanical problems and other circumstances that are beyond our control, we cannot be held responsible for late departures and/or arrivals. Just like in air travel, there are no refunds or partial refunds for delays.

Schedule Changes And Rerouting

Occasionally, it may become necessary to change departure times or reroute a trip in anticipation of travel conditions, road closures or weather conditions. Schedule changes occur to prevent lengthy delays. A schedule change is not a trip cancellation or delay; however, the schedule change can be up to 4 hours prior or 4 hours later than originally published. Full or Partial refunds are not available for schedule changes or reroutes and we apologize in advance for any inconvenience it may cause.

Trip Cancellations

In the event that Florida Shuttle Services, one of its operators or affiliate partner cancels a trip, we will make all efforts to re-accommodate passengers to the next available departure or provide for a 100% refund of the service not provided which would be total of reservation paid for. Florida Shuttle Services is not liable for extra expenses incurred or done by customer with other parties not Florida Shuttle Services.
If by any reason refund was not processed and its been more than 30 days past the incident, customer is not entitled to refund any longer. Time frame of up to 30 days will be provided for refund requests if for any reason the refund wasn’t processed immediately after incident.

Damages to Equipment

Customers will be responsible for any damage caused by their negligence.

Prices Subject To Change

We reserve the right to change prices with no notice. Once booked, you are guaranteed your fare will not increase. Once you book your ticket, you are locked into that fare.

Right To Refuse Services

We reserve the right to refuse transportation to anyone deemed unsafe or unsuitable for travel. Passengers whom are denied boarding will not receive any type of refund or compensation. Passengers who intimidate, threaten or interfere with any employee or fellow passenger will be denied boarding. Raised vocal tones are deemed intolerant and will be dealt with accordingly. Please be considerate of fellow passengers. Customers whom are denied boarding will no longer be able to travel with us for future trips.

Customers Of Size

Customers who are unable to occupy one seat or who compromise any portion of adjacent seating should pro-actively book the number of seats needed prior to travel. The seat is considered to be the 17 inches in width. This purchase serves as a notification of a special seating need and allows us to process a refund of the additional seating cost after travel (provided the trip doesn’t oversell). Most importantly, it ensures that all on board have access to safe and comfortable seating. If you are cannot meet the requirements outlined above, please ensure that you book 2 seats to ensure availability. It is our policy that customers who do not identify themselves will be denied boarding in cases where the shuttle is full and unable to accommodate them.

4. Additional Charges

The fares on our website are all inclusive which means there is no additional cost once you have purchased a ticket other than the gratuity for the driver.

5. Baggage Policy

Schedule Service/Shared Shuttles
All vehicles are equipped to carry two pieces of luggage per person. 1st bag up to 50lbs, 2nd bag will be the carry-on. If you have more bags please make the necessary changes in the online reservation system or call us in advance to let us know. We reserve the right to charge an additional fee.

The maximum allowable weight of your 1st luggage is 50 lbs. You must be able to carry your own luggage – if it is too heavy for you, it is too heavy for our drivers and they will not carry it.

All carry-ons must be able to fit in the overhead compartment or under the seat in front of you. For safety, bags are not permitted in the isle at any time.

Florida Shuttle Services or its affiliate partners reserve the right to refuse any carry-on or checked luggage for security purposes.

Luggage Identification Tags are required on each piece of checked luggage. Regulations require that each piece of baggage have an identification tag attached to it, which must include the owner’s home address and telephone number. It is the bag’s owner responsibility to do the above for security reasons. “Florida Shuttle Services nor its affiliate partners will be liable for any reason neither for baggage nor personal lost or stolen items”. This is the sole responsibility of the passenger/customer.

6. Equipment

We reserve the right to substitute equipment based on operational need. We never guarantee a certain equipment type (i.e. Motor-coach, Mini-bus, or a Van)

7. Limitation Of Liability

Neither the company, nor the service provider, shall be liable in any event or for any reason, including breach of this agreement, either directly or indirectly, to the other party or any third party for any special, indirect, incidental, punitive, exemplary, or consequential damages or loss of profits arising out of this agreement, even if such damages. It is expressly agreed that neither the company nor the service provider shall under any circumstances be liable to any party for an amount greater than the fee paid to us. We do not compensate additional for inconvenience.

8. Release Of Liability

The Company, its employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents and assigns do not own or operate any equipment or Service Provider which provides, or is to provide, goods services for your trip, including, transportation companies. The Chartering Party (for itself and on behalf of the Passengers) hereby expressly agrees that The Company shall not be responsible in any manner for the acts or failures to act, negligently, willfully or otherwise, of the Service Provider or its employees, agents or representatives. The Chartering Party (for itself and on behalf of the Passengers) also expressly agrees that The Company shall not be liable for any bodily injury or harm, accidents, property damage or personal loss as a result of the Services Services provided under the Service Contract. To the fullest extent permitted by law, and notwithstanding any other provision of this Agreement, the Chartering Party and its passengers agree, in consideration for the services provided by The Company, to indemnify and hold The Company harmless from any and all damages, injuries, claims and causes of action, of any type or kind, whether or not caused in whole or in part by the negligence of The Company, its employees, agents or representatives or the Service Provider or its employees, agents or representatives. The Chartering Party (for itself and on behalf of the Passengers) hereby expressly agrees that if any portion of the Service Contract, including the terms of the Limitation of Liability paragraph or this paragraph, is found to be void or unenforceable, the remaining portions of this Service Contract shall remain in full force and effect.

9. Force Majeure

The Company and the Service Provider shall not be liable for any failure or delay in performing their obligations under the Service Contract, and neither party shall be deemed in breach of its obligations thereunder, if such failure or delay is due to Acts of God, natural disasters, national, state or local states of emergency, acts of war or terrorism, labor strike or lock-out, or other industrial or transportation accident caused by any third party, any violation of law, regulation or ordinance by any third party or any other cause not within the control of The Company or the Service Provider, respectively.

10. Prohibited Items

The following items and activities are prohibited without the written consent of The Company:

(i.) Decorations; (ii.) Alcoholic Beverages (a fee, per bus, may be required if alcoholic beverages are allowed by The Company and the Service Provider); (iii.) Smoking; (iv.) Glass containers; (v.) Golf shoes or other shoes with spikes; (vi.) Generators or non medical oxygen containers.

Additional Prohibited items

acids, ammunition, animals, combustible liquids, compressed gases, corpses, cremated remains, explosives, firearms of all types, fireworks, flammable liquids, furniture, hazardous materials (poisons, radioactive materials, etc.), materials with a disagreeable odors are strictly prohibited to be checked in or brought on-board.

Oversize Items

A bicycle can be considered as one (1) piece of allowable luggage. Bicycles will be transported when disassembled and contained in wood, leather, canvas or other carrying case that does not exceed 8″ x 32″ x 60″ and which is securely fastened. There is a $25 – $75 fee assessed for excess, oversize or overweight items as defined in the section above.

11. Infants/Children

All children are required to travel on their own seat, therefore all customers including children must pay for a seat. All children regardless of age must be counted on private shuttles as well. This is for the sole security and safety of the children.

12. Unaccompanied Minors

Only passengers 16 years of age or older are permitted to travel without a parent or guardian (unaccompanied) as long as an adult is waiting with them until picked up and an adult is waiting at the drop off location. Minors under the age of 16 are not permitted to travel unaccompanied for any reason.

Carriage is at the discretion of Florida Shuttle Services.

13. Child Seats

Child seats up to two will be provided upon request and are not guaranteed. We do not charge for child seats up to two and as such have no affect on the cost of transfers. If additional car seats are required there is a cost of $15 per car seat. The use of the child seat is at your own risk and you release us from any and all liability for any injury whether directly or indirectly caused by us or any other agent assigned by us.

14. Privacy Policy

At Florida Shuttle Services, we are concerned about your privacy, and take steps to safeguard the information you submit to us, whether over the Internet, by telephone, or by other means. We do not share information about you with any third party without your specific consent. If you have further questions concerning the policy or the safety of your personal information, please contact us.

Only the confirmed passenger may make changes to a reservation regardless of the amount of people traveling.

We do not ever release information as to who is or how many passengers are on a particular shuttle.

14 (a). At no time will any employee discuss a reservation with anyone except the customer of record, including with anyone who claims to be a “family member”. Florida Shuttle Services does not and will not disclose or discuss any reservation except with the customer of record or if placed with a travel agent their agent of record. Customers whose travel was reserved through or paid for by a travel agent must have their travel agent contact to make any changes. Changes may be made to a reservation by email only which is stipulated on contact page: [email protected] . Florida Shuttle Services will not verify any customers reservation except with the party of record.
